The Office of Risk Management Services (RMS) assists Departments when it becomes necessary to purchase insurance for risks not covered by the self-insurance programs. The following is a list of various commercial insurance policies that are available. Others may be available for specific activities as needed. Departments requesting these insurance policies generally bear the cost of the premium. Self-Insurance Liability Policy (SILP)
EWU's liability for the negligent acts of its employees is covered through the State of Washington Self-Insurance Liability Policy (SILP) administered by the State of Olympia. The coverage only applies when non-University employees (or their property) are injured/damaged by the negligence of an EWU employee or agent. In order for the coverage to apply, the employee or agent must have been acting in good faith on behalf of EWU and within the scope of the duties assigned to the individual by EWU at the time the loss occurred. EWU pays a substantial premium for this policy based on a five-year claim history. Examples of coverage include:
- General Liability, including Auto Liability - Covers injury or damage to a person who is not employed by the university or to non-EWU property. The injury or damage must be caused by the negligence of EWU, its employees, or agents.
- Professional Malpractice - For faculty, staff, volunteer, and students performing clinical practice on campus. (Note: Students performing clinical practice off-campus are not covered, but may purchase their own separate professional liability student insurance.)
The SILP Coverage:
- Pays tort claim judgments and settlements
- Defends and indemnifies employees and authorized agents when sued personally for negligence (so long as acting in good faith in the performance of their EWU duties)
Coverage does not include:
- Marine Hull and Vessel Operations
- Aircraft Liability
- Employee Fidelity
- Student Sponsored Events
- Damage to State Owned Facilities and Property
- Injuries Covered by Workers Compensation or Similar Policies
- Injuries/Damages on Foreign Soil
Note: For liability issues not covered by SILP, commercial insurance may be available for purchase by the Departments through the State Risk Management Office. In order to purchase such insurance, the department must submit a written request to the EWU Office of Risk Management.
Vehicles
This policy covers supplementary payments such as bail bonds, the cost to release attachments in any suit against EWU, any interest on the full amount of judgment because of a suit, out of state coverage, comprehensive coverage such as a vehicles collision with another object or overturning, losses caused by fire, lightning, explosions, theft, windstorms, hail or earthquakes, floods, mischief or vandalism, sinking, burning collision or derailment of any conveyance transporting the vehicles, towing expenses, glass breakage, and transportation of vehicle because of damage. This policy will only covers vehicles that are added to the insurance policy. Property damage claims for damage to EWU owned vehicles are made to the EWU Office of Risk Management per EWU Safety Policies and Procedures Manual " Reporting Motor Vehicle Accidents", using a Standard Form 137, Vehicle Collision Report Form. This form is to be filled out online, with a PDF of the report forwarded to the supervisor, who will review and forward the report, via email, to riskmanager@ewu.edu.
If law enforcement does not respond to the accident, drivers are required by law to complete and file the Washington State Patrol Collision report form 161. At the link, search for the Citizen Report and complete the form.
Athlete Insurance
This policy covers loss of life, loss of body parts, loss of one of the five senses, hospital room and board, intensive care room and board, hospital miscellaneous expenses, outpatient hospital expenses, surgical benefits, doctors's visits, x-rays and labs, nursing services, physiotherapy, ambulance, medical equipment rental, medical services and supplies, dental treatment, and prescription drugs. This applies to EWU athletes only (NOT including clubs or orgs).
Boiler and Machinery
This policy covers property damage to declared equipment, loss of business income because of equipment failure/damage, spoilage damage, utility interruption, civil authority cases, electronic date or media, error in description of location of equipment, fungus, wet or dry rot, hazardous substances, newly acquired equipment, refrigerant contamination, water damage, and demolition/construction costs.
Commercial Fire Policy
This policy covers buildings and building contents, as well as business personal property, personal property of others, personal property at undeclared premises, personal property in transit, sales representative property, debris removal, expediting expenses, fire department service charge, fire protection equipment discharge, green building alternatives, fungus, wet or dry rot, pollutant cleanup and removal, preservation of property, rewards for recovered, damaged or stolen property, stored water, and water or other substance loss.
Earthquake and Flood
This policy covers buildings and structures, building and structure contents, business personal property, tenant improvements and betterments, loss of business income, rental value, debris removal, and preservation of property.
APIP (Property Policy)
This policy covers information security and privacy liability, privacy notification costs, regulatory defense and penalties, website media content liability, cyber extortion, first party data protection, and first party network business interruption.
Early Head Start Business Owner's
This policy covers Early Head Start buildings and building contents, as well as personal property of students, staff, and faculty members.
Crime Fidelity Bond
This policy covers employee theft, forger or alteration, theft of money and securities inside the premises, robbery or safe burglary of other property inside the premises, theft, robbery or burglary outside the premises, computer fraud, funds transfer fraud, money orders and counterfeit money.
OnCall International
This policy provides pre-trip plans, medical monitoring, emergency medical evacuation and repatriation, return of remains, return of dependent children, visits by family and friends, emergency return home, bereavement reunion, 24 hour nurse help line, prescription assistance, deposit, advance and payment guarantees, medical dental, and pharmacy referrals, dispatch of medicine, coordination of benefits, pre-trip information, 24/7 travel arrangements, translator and interpreter referral, emergency travel funds assistance, legal consultation and referral, lost and stolen travel documents assistance, emergency message forwarding, lost luggage assistance, political evacuation, natural disaster evacuation, medical expenses, accidental death and dismemberment benefit, administrative access to Searchlight (On-Call Site Portal).
Please note that coverage through OnCall is mandatory for all EWU students participating in a study abroad program. Additional charges for enrollment in the OnCall coverage will be applied to your EWU student account and you will receive email notifications to your eagles email of your enrollment. Students participating in a 3rd Party Provider program may use that company's insurance provided it is equivalent to the EWU mandatory coverage. In this case, proof of equivalent coverage must be sent to EWU's School of Global Learning.
Foreign Liability Insurance
Foreign Liability provides general liability and automobile liability coverage for Washington state employees who are traveling in foreign countries on state business. Click here to view a summary of coverage.
Marine and Hull Liability Insurance
This policy covers any damage to watercraft, the hull or any declared property in the watercraft.
Out of State Workers' Compensation
This policy covers bodily injury by accident or by disease. This includes resulting death from either injury by accident or disease. The employee must be doing business on behalf of EWU and must be in the United States or Canada.
Commercial Cyber Liability Insurance
This policy covers cyber risks including data privacy issues, virus/malicious software transmission to a third party, business interruption and data recovery, regulatory defense and fines, cyber extortion, website or media misuse, and infringement of intellectual property. It also covers 1st party and 3rd party liability.
Student Interns - Medical Malpractice, General Liability, and Professional Liability
This policy covers EWU students who are part of a medical or non-medical internship and protects the students and the university from any claims that may be made against either the student or the university as a result of something the student did as part of their internship.
Project H.O.P.E.
This policy covers any loss or damage from the result of an act of terrorism and miscellaneous medical professional liability.
